PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that the applicant was charged with failing to exercise the necessary leadership expected of an officer of his grade; and, leaving post without authority while serving as Staff Duty Officer. On 30 September 1999, applicant was notified of initiation of elimination proceedings, under the provisions of Chapter 4, AR 600-8-24, paragraph 2b and 24a(1) by reason of unacceptable conduct/misconduct, moral or professional dereliction. He was advised of his rights by a member of the Judge Advocate General Corps. On 4 October 1999, the applicant acknowledged notification of his proposed separation action. On 28 October 1999, the applicant voluntarily tendered his resignation from the service under the provisions of Chapter 4, AR 600-8-24, in lieu of elimination proceedings, and waived his rights to appear before a board of officers, and did not submit a statement in his own behalf. On 10 December 1999, the commanding general, Ft. Benning, Georgia, recommended approval of the resignation with issuance of an honorable discharge. The Ad Hoc Review Board recommended that the applicant’s resignation be accepted with issuance of an honorable discharge. On 10 February 2000, the Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the Army Ad Hoc Review Board and directed that the applicant be discharge with a characterization of service of honorable . On 16 February 2000, Commander, PERSCOM, Alexandria, VA, approved the applicant’s request for resignation in lieu of elimination and directed that the applicant be discharged with a characterization of service of honorable.

         b. On 1 March 2000, the applicant was discharged. At the time of discharge, the applicant had completed 4 years, 9 months, and 27 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 600-8-24 sets for the basic authority for Officer transfers and discharges. Chapter 4 outlines the policy and procedure for the eliminating officer from the active Army for substandard performance of duty, misconduct, moral or professional dereliction, and the interest of national security.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The record shows that the applicant voluntarily tendered his resignation under the provisions of Chapter 4, AR 600-8-24, in lieu of elimination proceedings. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge was both proper and equitable, voted to deny relief.
